For most American homeowners, their home is not only their greatest financial asset but also a key source of financial stability, community, and personal pride. Homeowners insurance is an essential financial tool to protect their homes in case of unexpected damage. This product is mandatory for consumers with a mortgage on their home. However, in recent years escalating climate disasters and spiking prices in the global reinsurance market have placed serious financial strain on the homeowners insurance system and on homeowners across the United States.

Today many consumers struggle to afford steeply increased premiums, while others find it difficult to obtain insurance in the private market altogether. Concerns are growing that many American homeowners are forced by financial realities to forego homeowners insurance, sometimes called “going bare.” But going bare puts consumers at risk of accruing significant financial debt to repair their homes, having to live with unsafe and inadequate housing conditions, or moving from homeowner to homeless after disaster strikes.

Based on an analysis of 2021 American Housing Survey data from the US Census Bureau,
this report finds that:

• One in thirteen homeowners across the United States are uninsured (7.4 percent),
equivalent to 6.1 million homeowners.

• Homeowners making under $50,000 a year are twice as likely as the general
population to be uninsured (15 percent).

• Homeowners of color are disproportionally at risk, with an estimated 22 percent
of Native American, 14 percent of Hispanic, and 11 percent of Black homeowners
having no homeowners insurance.

• Over one third (35 percent) of owners of manufactured homes, as well as 29 percent
of those who have inherited their homes, have no homeowners insurance.

• Homeowners living in rural areas and those living in the metropolitan areas of Miami
and Houston are most likely to not have homeowners insurance.

• Even with conservative estimates, an estimated $1.6 trillion in property value of
uninsured homes was at risk in 2021: this includes $339 billion of uninsured Hispanic owned homes and $206 billion of uninsured Black-owned homes.

We conclude by offering research and policy recommendations:

1. More data are needed to track insurance gaps and pre-existing and emerging
inequalities in insurance markets.

2. The precarity of the homeowners insurance market poses a systemic risk to our
nation’s housing markets. Fixing this will require both investing in risk reduction and
reducing insurers’ overreliance on unregulated reinsurance.

3. Unavailable and unaffordable homeowners insurance continue to impact the racial
wealth and homeownership gaps. We need more research that examines racial
discrimination in insurance markets

CFA published research highlighting the high fees many small company retirement plans and their participants pay. The costs of these plans can vary considerably and the investing outcomes for retirement savers that result from these differences can be staggering over time. The fees in a significant number of small company retirement plans are so high that they eliminate the tax benefit associated with investing in a tax deferred plan. Research by CFA documents how easy it is to obtain a real estate license by taking a required course and passing a state license exam.  More than 1.5 million Realtors (plus other agents) compete to sell 5-6 million homes a year, with Realtor sales agents receiving a median net annual income of only $25,000.

The report shows that it is much less demanding to earn a real estate sales license – which takes a state median of nine weeks at a state median cost of $600 – than earning a license to practice almost all other financial services occupations, which normally require a college degree as well as special training.  It is even easier to earn a real estate sales license than to practice many manual occupations, from plumbing to hairdressing, which usually require an apprenticeship of more than 1,000 hours as well as coursework.

Cancers attributable to drinking alcohol pose a severe public health burden, yet most consumers are not aware of the link between alcohol and cancer. This combination of high harm and low awareness presents policymakers with the rare opportunity to significantly improve public health by simply providing information to consumers. Cancer warning statements on alcoholic beverage labels, on alcohol advertising, and on signage at point-of-sale represent three low-cost options for doing so. This article explores the benefits and disadvantages of the three options, focusing in particular on the latter two, in which state and local governments have the potential to lead. Raising awareness of alcohol cancer risk may help to reverse trends towards higher levels of alcohol consumption and abuse, and even where raising awareness does not affect an individual’s drinking behavior, it may nevertheless foster support for other public policies that reduce harms associated with excessive alcohol use.

The Consumer Federation of America released a new report that uses industry sources to document the costs to industry and to consumers of too many residential real estate agents.  More than 1.5 million residential agents (including brokers) compete for home sales usually totaling 5 to 6 million annually. The report documents complaints by many experienced, full-time agents of the incompetence and/or inattention of other agents that also harm consumers.  And it emphasizes that because of the “surfeit of agents,” real estate agents and brokers feel financial and/or peer pressure to keep commission rates relatively high.

CFA surveyed the websites of 320 of the some 1,300 Dignity Memorial funeral homes in the United States.  The survey found that three-quarters of the websites posted price lists somewhere yet only about one-third of all surveyed websites included a link to these prices on the home page that could be found with little scrolling down.  In nearly one-third of the surveyed websites, it appears that the funeral homes were trying to hide the price lists.

Auto insurers are increasingly using telematics programs to get consumer-generated driving data, and using that data for insurance pricing. Telematics poses substantial promise for consumers, but also poses major risks related to insurance costs, discrimination, and data privacy. Strong, effective oversight and regulations are needed to make sure telematics benefits consumers and is not misused.

In this presentation to the Consumer Liaison Committee at the 2022 fall meeting of the National Association of Insurance Commissioners, Consumer Federation of America calls on insurance regulators to adopt the following telematics reforms:

1) Laws and bulletins requiring transparency in telematics

2) Strict standards for data collected and used by insurers

3) Transparency regarding the algorithms are that are used in these programs

4) Strong measures to protect consumer privacy, and testing to weed out unfair discrimination and racism.

This Issue Brief serves to inform the U.S. Department of Energy (DOE) and policymakers that there is widespread public support for federal appliance energy efficiency standards across key U.S. demographic groups. Supporting evidence is derived from a nationally-representative survey of 4,000 U.S. adults that asked about consumer attitudes towards national appliance standards and payback periods, and revealed new data on appliance purchasing decisions by race, income, and homeownership.

More stringent energy efficiency standards will benefit all consumers through energy bill savings. Survey results indicate high levels of public support for federal energy efficiency standards. Among all respondents, 76% said they support standards. Among different demographic subsets broken out by race, income, and homeownership status, support remained high, ranging from 72% to 82%. Support remains strong in response to questions about support for efficiency standards with different payback periods. The survey showed that 71% of respondents support standards within a three-year payback period and 64% within a five-year payback period. A majority of all respondents, 54%, support standards within a ten-year payback period.

A new Consumer Federation of America report on residential real estate commissions in New York City reveals huge differences in commission rates throughout the city.  It shows that typical (median) rates paid to buyer agents range from 1% in parts of Brooklyn to 3% in Manhattan while typical total commission rates are 3% in Brooklyn and 6% in Manhattan.  The gap in total compensation is even larger because homes in Manhattan cost more than homes in Brooklyn.

CFA conducts an annual survey of city, county and state consumer agencies across the country to ask about the complaints they received in the previous year. Twenty-three agencies from across the country participated in this year’s survey, which provides a snapshot of the most common, fastest-growing, worst, and newest problems consumers reported in 2021. These agencies handle complaints from consumers on a wide range of topics, from auto sales to travel companies. Some also accept complaints from businesses. Unlike most federal agencies, state and local consumer agencies usually mediate complaints informally. Many also have the power to enforce the law through administrative procedures, civil action and/or criminal prosecution.

CFA released a new report on residential real estate brokerage that found no consistent relationship between home prices and commission rates.  “The research provides additional evidence that the structure of agent compensation is both inequitable and inefficient,” said Stephen Brobeck, a CFA senior fellow and the report’s author.

The report was based on a comparison of housing prices and buyer broker commission rates in 17,805 recent sales in 35 cities.

  • In ten cities, the rates were so uniform that meaningful comparisons could not be made.
  • In five cities, rates were fairly similar for all housing price categories.
  • In eight cities, higher-priced homes tended to carry higher commission rates than did lower-priced homes.
  • In only eight cities did higher-priced homes tend to carry lower commission rates.

The Funeral Consumers Alliance (FCA) and Consumer Federation of America (CFA) issued a report on the extent to which funeral homes post prices online, the importance of this posting, and the opportunity for the Federal Trade Commission (FTC) to update its Funeral Rule to require this posting.  A May 2022 Ipsos survey of 2,009 representative Americans revealed that 75 percent favor, and only three percent oppose, mandatory price posting for funeral homes with websites.

The report highlights some of the hundreds of complaints detailing deceptive and abusive practices concerning loans by EasyPay Finance, its parent company Duvera Billing Services, and Utah-based bank, TAB Bank, which helps EasyPay evade state laws. This report analyzes buyer agent commission rates on 17,805 home sales in several dozen cities throughout the United States.  The study found a high degree of uniformity among these buy-side rates.

  • In each of 10 cities, at least 87 percent of the home sales had identical commission rates.
  • In each of 18 cities, at least 70 percent of the sales had identical commission rates.
  • In each of 24 cities, at least 88 percent of the sales had commission rates between 2.5 and 3.0 percent.

The Consumer Federation of America released a policy proposal illustrating an alternate path for closing the African American homeownership gap. Honoring America’s Promise: How Passing Unused VA Loan Benefits Down to Veteran’s Descendants Could Narrow the African-American Homeownership Gap recommends a framework for transferring the previously unused home loan benefit for any veteran to the veteran’s surviving spouse, child, grandchild, and other direct descendant, without limitation. For purposes of the proposal, transferable VA loan benefits would have accrued to veterans whose service period roughly overlaps with the federal government’s support of racially restrictive housing policies, namely between the passage of the GI Bill in 1944 up through the enactment of the Community Reinvestment Act in 1977.
